IMACRAFT PRIVACY POLICY

OVERVIEW
This privacy policy (“Privacy Policy“) governs Retesys LLC (may be referred to herein as “Retesys“, “we“, “our” or “us“), information collection, processing and usage practices in connection with the use of the website www.imacraft.com (may be referred to herein as the “Site“) and/or any Imacraft-branded software products or services, that we operate or provide (“Software“, and together with the Site, the “Services“) in our capacity as controller.
This Privacy Policy details how your Personal Information is used by Retesys both actively and passively, when you use the Site and/or Services. With this Privacy Policy (together with our Terms of Service) and any other documents or policies referred to therein) we wish to outline the basis on which any Personal Information we collect from you, or that you provide to us, will be processed including, what information we may collect from you via the Site and/or the Services, how we may use such information, how we may disclose information provided by you to third parties and the use of “cookies” on the Site and by the Services.
Generally speaking, Retesys receives information because:
- You have provided it to us;
- We collect it from you; and/or
- Third parties we engage (such as data analytics providers) collect it from you on our behalf. This happens in cases where we use or deploy third party tracking technology, or where we otherwise give these third parties access to the Site, Software, and other technology. So where we describe below in the section named "Information We Collect From You" the ways in which we collect information from you, you acknowledge that such collection may also be carried out by third parties. These third parties may have their own privacy policies that they also adhere to.
TYPES OF INFORMATION WE COLLECT
We collect both Personal Information and non-personal information, such as Anonymous Information, about our Users. “Personal Information” is information that can be used to contact or identify you, such as your full name, email address, phone number, payment method and profile picture, as well as information that is linked to such Personal Information. “Anonymous Information” is information that is not linked to your Personal Information, cannot be used to contact or identify you and is not linked to information that can be used to do so, such as Personal Information. Anonymous Information includes passively collected information about your activities on the Site or on the Services or using our Software, such as usage data, to the extent that information is not linked to your Personal Information.
LEGAL BASES FOR COLLECTING AND USING INFORMATION
A note here for those in the European Union about our legal grounds for processing information about you under EU data protection laws, which is that our use of your information is based on the grounds that: (1) The use is necessary in order to fulfill our commitments to you under our Terms of Service or other agreements with you or is necessary to administer your account--for example, in order to enable access to our website on your device or charge you for a paid plan; or (2) The use is necessary for compliance with a legal obligation; or (3) The use is necessary in order to protect your vital interests or those of another person; or (4) We have a legitimate interest in using your information--for example, to provide and update our Services, to improve our Services so that we can offer you an even better user experience, to safeguard our Services, to communicate with you, to measure, gauge, and improve the effectiveness of our advertising, and better understand user retention and attrition, to monitor and prevent any problems with our Services, and to personalize your experience; or (5) You have given us your consent -- for example before we place certain cookies on your device and access and analyze them later on.
INFORMATION YOU PROVIDE TO US
You may provide Personal Information to us in the following ways:
Account
In order to use certain Services, you may be required to create an account (“Company Account“), which will require you to provide Personal Information, such as your name and email address. We may also offer the option of creating a Company Account through connecting via a third party account (for example, with a social media site – a “Third Party Account“), in which case you will be required to approve the connection as well as the types of information (which may include Personal Information) that is made available to us from, and the types of activities that we may perform in connection with, that Third Party Account. Even if you later disconnect your Company Account from the Third Party Account, we still keep a copy of the Personal Information that we received from the connection of the two accounts. In either case, we may send you an email or other electronic message confirming your Company Account creation (or otherwise instructing you how to confirm it).
Information Collected When You Contact Us
If you contact us, whether by submitting an online form that we make available or by sending an email to an email address that we display or provide, by using a feedback or reporting feature, or by other means, such as through contacting our Support team via phone, we may collect certain information from you, such as your name and email address.
Purchases
If you make a purchase via the Services, you will be required to provide certain billing data to process and fulfill the purchase. We may use the products and services of third party service providers to process and fulfill such purchases, in which case you will be providing the information to such third party services providers as well.
Profile
Some of the Services may enable you to build a public profile in connection with your Company Account (“Public Profile“). Your Public Profile may include your name, but you may choose to provide other Personal Information, such as a profile picture, a user name, and other information that we may offer you to present.
Blogs, Newsletters, Surveys and Promotions
The Site may contain blog displaying information about Retesys and some of its products and services. The Site may also offer you the opportunity to subscribe to newsletters and participate in surveys and other promotional activities. Your interaction (such as responding on the blog comment, subscribing to a newsletter, or participating in a survey) may require you to provide certain Personal Information such as your name and email address, together with any additional Personal Information you choose. You should read the separate terms and conditions that govern these activities, if any.
Social Media
When you participate in one or more activities through our Site and Services or directed at our official pages on various social media platforms, we may collect additional information provided by you for such participation. You should read the separate terms and conditions that govern those social media platforms.
INFORMATION WE COLLECT FROM YOU
We collect Personal Information and other non-personal information, such as Anonymous Information, from you in the following ways:
Log Files; Device and Usage Data & IP Address
We collect information through server log files, but also by deploying tracking technologies within the Site and the Services, and we may also associate this information with your Company Account. We do this to analyze trends, track user movement around the Site and Services, gather demographic information, and to generally collect information that we may find insightful or helpful. The type of information collected may include (but is not limited to) internet protocol (IP) addresses (which may vary from session to session), mobile network information including device type and hardware model, browser type, operating system type, type of browser, Internet Service Provider (ISP), date/time stamp of Site or Service use, referring/exit pages, and clicked pages. Cookies
Cookies are small data files that are placed on your computer or mobile device when you visit a website. Cookies are widely used by website owners like Retesys to make their websites work, better understand how site visitors use the website, and provide more targeted content to its site visitors. Cookies created and set by the website owner (in this case, Retesys) are called "first party cookies.” Cookies created and set by parties other than Retesys are called "third party cookies.” First party cookies are used to provide essential services, such as re-setting your password. Third party cookies enable third party features or functionality to be provided through the website and allow those third parties to serve ads to you across different websites you visit. We use first party and third party cookies for several reasons. Some cookies are required for technical reasons in order for our website to operate, and we refer to these as "essential" or "strictly necessary" cookies. For instance, a dropping a first party cookie is necessary for you to reset your password. In addition, third party cookies help us create a more favorable marketing experience. Web Beacons
Cookies are not the only way to recognise or track visitors to a website. We may use other, similar technologies from time to time, like web beacons (sometimes called "tracking pixels" or "clear gifs"). These are tiny graphics files that contain a unique identifier that enable us to recognise when someone has visited our website. This allows us, for example, to monitor user traffic patterns on our website, to deliver or communicate with cookies, to understand how you arrived at our website (e.g. from an online advertisement or search engine), and to measure the success of our marketing programs (e.g. e-mail marketing campaigns). In many instances, these technologies are reliant on cookies and web beacons to function properly, and so declining cookies will impair their functioning.
Analysis Tools and Internet Technologies
The legal basis for the processing of your data along with collective analytical tools and internet technologies is our rightful interest towards an analysis of the activities on our website and Users’ behavior on the Site, as well as our interest (and the interest of third parties) in the inclusion of personalized advertisement suited to your interests.
Google Analytics
This Site uses Google Analytics, a web analysis service provided by Google Inc. (“Google”). Google Analytics makes use of cookies that allow an analysis of your use of the website. In principle, the information about your use of our website as displayed by the cookie is transferred to and stored on Google servers in the United States. We activated IP anonymization on this website, which means that Google shortens the IP addresses from within EU Member States or from other EEA treaty states before they are exported to the United States server. Only in exceptional cases, the full IP address may be transferred to the United States Google server before it is shortened in the United States.
As instructed by this Site’s operator, Google will use the information for the purpose of analyzing your use of our Site, to compose reports on the activities on our Site and to provide further services to the website’s operator related to the use of the website and the internet. The IP address that is transferred by your browser and that is shortened before storing for the purposes of Google Analytics will not be added to other Google data. You can prevent the storage of the cookies through the applicable settings of your browser software, however we remind you that, in certain instances, this may cause that you will not be able to use all functions of our Site to the fullest extent possible.
Retargeting
This website makes use of retargeting technologies that are administered by other operators. Through retargeting, users of our partners’ websites, who were interested in our Site and in our Services before, can be approached with personalized advertisements. Studies show that the inclusion of personalized advertisements that are related to people’s actual interests are more appealing to the user than advertisements without any personal connection. Through retargeting, the incorporation of advertisements is based on the analysis of cookies that display earlier user’s conduct. Of course, no personal information is stored in this process and, obviously, the use of retargeting technology occurs in compliance with the legal provisions on data protection. If you do not consent to this mode of advertisement, you can deactivate cookies and/or delete existent cookies through your browser settings.
Click Stream Data
As you browse the Internet, a trail of electronic information is left at each web site you visit. This information, which is sometimes called “clickstream” data, can be collected and stored by a web site’s server. Clickstream data can tell us the type of computer and browsing software you use, the address of the web site from which you linked to the Site, and in some instances, your e-mail address. We may use clickstream data to determine how much time visitors spend on each page of the Site and how they navigate through the Site. We will only use this information to improve the Site.
THE WAY WE USE PERSONAL INFORMATION
All of the ways in which we use or process your Personal Information, as described further below in this clause or elsewhere in this Privacy Policy, are based on one of a number of legal conditions provided for under applicable data protection laws. Typically these will include:
- processing which is necessary for a contract we have entered, or are entering, into with you – for example, processing payment information in relation to purchases via the Services;
- processing which is based on your consent – for example, when you voluntarily provide us with your contact information so that we can respond to a query you have raised with us;
- processing which is within our legitimate interests as the operator of the Site and Services – for example, associating browser generated information with your use of the Services so that we can tailor or improve the Services for you;
- processing which is necessary to comply with our legal obligations; and
- processing which is necessary to protect our rights and interests.
In addition to the uses of Personal Information described elsewhere in this Privacy Policy, we also use Personal Information in the following ways:
- administer and provide the Site and Services to you;
- further develop and improve the Site and Services;
- show certain Company Account information and/or Public Profile such as your user name and profile photo;
- send you updates, promotions, offerings, or other news of/about the Site, Services and/or Retesys;
- respond to communications with you;
- offer customer support;
- identify or authenticate your access and use of the Site or Services; and/or
- send you updates and marketing information related to our products and services, subject to any consents required under local laws.
Transfer to Third Parties
The Services may not be hosted by us. All or some of the hosting may be done by third party service providers that we engage. This means that data you provide us or that we or third parties collect from you (including any Personal Information), may be hosted with such third party service providers on servers that they own or control. Regardless of where such third party service providers are located (some of which may be located in the United States), their servers may be located anywhere in the world (including the United States). Your data may even be replicated across multiple servers located in multiple countries. We send or otherwise share Personal Information to/with various third parties that help us with our business operations and help us understand how our users use the Site and Services, and to develop and improve them. Also, just as with our third party hosting providers, these third parties may be based (and their servers may be located) anywhere in the world.
Merger, Sale or Bankruptcy
In the event that Retesys is acquired by, or merged with, a third party entity, we may (and hereby reserve the right to) transfer or assign the Personal Information and other information we have collected or received.
Enforcement
We may send or otherwise share your Personal Information with any third party if we believe that disclosure of such information is helpful or reasonably necessary to: (a) comply with any applicable law, regulation, legal process, or governmental request; (b) enforce the terms of service/use governing the Site and/or Services, including investigations of potential violations thereof; (c) detect, prevent, or otherwise address fraud or security issues; and/or (d) protect against harm to the rights, property or safety of Retesys, our users, yourself, or the public.
PUBLICLY AVAILABLE INFORMATION
Any content that you make publicly available on or via the Site or Services (such as your Public Profile) will be publicly available to other Users of the Site or such Services. If you actively or passively allow your contact information to be public, you may receive unsolicited messages or activity from other users of the Site or such Services. We therefore encourage you only to post information that you are sure you want to be publicly accessible.
AGGREGATED ANONYMOUS INFORMATION
“Aggregated Anonymous Information” is information that we cannot use to contact or identify you and is not linked to information that can be used to do so. It includes passively collected information about your activities on the Site or while using our Services or our Software, such as usage data, to the extent that information is not linked to your Personal Information. We may use Aggregated Anonymous Information collected from our Site or our Services to:
- improve the services we provide through the Site and the Services and customize the user experience, such as by providing targeted useful features and promotions based on the type of services you seek; and/or
- aggregate the information collected via cookies and similar technologies to use in statistical analysis to help us track trends, evaluate the effectiveness of our ads and analyze patterns.
DO NOT TRACK
We do not currently respond or take any action with respect to web browser “do not track” signals or other mechanisms that provide consumers the ability to exercise choice regarding the collection of Personal Information about that individual consumer’s online activities over time and across third-party websites or online services. We may allow third parties, such as companies that provide us with analytics tools, to collect Personal Information about an individual consumer’s online activities over time and across different websites when a consumer uses the Site and/or a Service.
SECURITY
The security of your Personal Information is important to us, but remember that no method of transmission over the Internet, or method of electronic storage, is 100% secure. While we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security.
RETENTION OF YOUR PERSONAL INFORMATION
We will retain your Personal Information only for as long as necessary to fulfil the purpose(s) for which it was collected and to comply with applicable laws. Your consent to such purpose remains valid after termination of our relationship with you. In principle, we store your data as long as it is required to deliver the Services and as long as we have the rightful interest towards saving it for an extended period of time (for instance, after fully executing a contract, we may still have a rightful interest towards the use of your data for marketing purposes). Excluded from deletion is only the data we need for the execution of pending tasks and the data we need to realize our rights and our claims, as well as certain data that we must store for a legally mandatory longer period of time. When certain data is only saved due to a legally mandatory preservation term, the processing of it by us is limited, even without your request.
OPTING OUT
You may choose not to receive future promotional, advertising, or other Site- or Services-related emails from us by selecting an unsubscribe link at the bottom of each email that we send. Please note that even if you opt out of receiving the foregoing emails, we may still respond to communications initiated by you, as well as send administrative emails that are necessary to facilitate your use of the Site and/or Services (for example, emails confirming user registration, and updates to our policies).
YOUR RIGHTS
We would like to maintain accurate Personal Information, and we endeavor to comply with all rights you might have under data protection laws. If you would like to delete, access or correct any of your Personal Information that we may be storing, there may be tools that we make available via the Services. Otherwise, please contact us at privacy@retesys.com to make your request. We will treat your request in accordance with applicable laws.
BEHAVIOURAL ADVERTISING
As described above, we use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. Occasionally, at our discretion, we may include or offer third-party products or services on our website. These third-party sites have separate and independent privacy policies. We therefore have no responsibility or liability for the content and activities of these linked sites. Nonetheless, we seek to protect the integrity of our site and welcome any feedback about these sites.
CALIFORNIA PRIVACY RIGHTS
California Civil Code Section 1798.83 permits our customers who are California residents to request certain information regarding our disclosure (if any) of Personal Information to third parties for their direct marketing purposes. To the extent applicable, you may make such a request by sending an email to privacy@retesys.com. Please note that we are only required to respond to one request per customer each year.
DELETION OF CONTENT FROM CALIFORNIA RESIDENTS
If you are a California resident under the age of 18 and a registered user of certain parts of the Services, California Business and Professions Code Section 22581 permits you to remove content or Personal Information you have publicly posted. If you wish to remove such content or Personal Information, please contact privacy@retesys.com, and provided you specify which content or Personal Information you wish to be removed, we will do so in accordance with applicable law. Please be aware that after removal you will not be able to restore removed content or Personal Information. In addition, such removal does not ensure complete or comprehensive removal of the content or Personal Information you have posted and that there may be circumstances in which the law does not require (or allow) us to enable removal.

You can review the most current version of the Privacy Policy at any time at this page.
Retesys reserves the right to change or modify the Privacy Policy at any time and in its sole discretion by providing notice that the Privacy Policy has been modified. Such notice may be provided by sending an e-mail, by posting a notice on the Site, by posting the revised Terms on the Site and revising the date at the top of this Privacy Policy or by such other form of notice as determined by Retesys. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
